Define Dutch — Terms of Service
Welcome to Define Dutch! These Terms of Service (“Terms”) govern your access to and use of our website, tutoring sessions, learning materials and related products. By signing up, you agree to these Terms. Please read them carefully (with a coffee in hand if needed ☕).
1. Who We Are
Define Dutch is a language learning platform that helps you actually speak Dutch through:
The Tutor-Coach Model (your tutor is also your coach).
The Speak-First Method (talk Dutch from Session 1).
Beyond-the-session support (missions, challenges, community).
Our mission: help learners worldwide integrate Dutch into their daily lives with confidence.
2. Accounts & Eligibility
2.1. Age Requirement
You must be at least 16 years old to create an account.
2.2. Accuracy
All information you provide must be true and up to date.
2.3. Security
Keep your login details private. You’re responsible for all activity on your account.
2.4. Termination
You may close your account anytime. We may suspend or terminate your access if you breach these Terms (e.g. sharing materials illegally, non-payment, harassment).
3. Using Define Dutch
3.1. Personal Use Only
You get a limited, non-exclusive license to use our services for your personal learning.
3.2. Don’ts
You agree not to:
Share your account or course materials.
Copy, resell, or redistribute content without permission.
Use Define Dutch for unlawful, offensive, or harmful purposes.
4. Payments, Plans & Refunds
4.1. Flex Pass (Subscription)
€45/month includes 1 tutor-coach session.
The included session must be used within that billing month. It does not roll over, convert into credits, or carry into future months.
Extra tutor-coach sessions are pay-as-you-go (€39 each) and invoiced at the end of the month.
Subscriptions auto-renew monthly unless canceled before the renewal date.
Cooling-Off Right (14 Days)
Under EU/NL law, you may cancel your subscription within 14 days of your first purchase. If you have already used a tutor-coach session during this period, the value of that session will be deducted from any refund. Renewals do not reset the 14-day right.
4.2. Sprint (10-Day Program)
One-time fee €799 for 10 private tutor-coach sessions in 10 consecutive days (with 2 weekend days in between).
Cancel up to the end of Day 2: unused days are refunded at €79.90 per day.
Example: Cancel after Day 1 → refund 9 days.
Cancel after Day 2 → refund 8 days.
After Day 2, the Sprint is non-refundable.
By booking your first Sprint session, you agree to immediate delivery of the service and waive the 14-day withdrawal right.
4.3. Billing & Payment Authorization
By subscribing, you authorize Define Dutch to charge your payment method for:
Monthly subscription fees, and
Extra tutor-coach sessions booked during the billing period.
Charges are made automatically at the end of each billing cycle.
4.4. Failed Payments
If a payment fails or authorization is revoked:
You remain responsible for the outstanding balance.
We may suspend your access until payment is completed.
Unpaid balances may be pursued through debt collection procedures, including reasonable recovery costs.
4.5. Refund Processing
Refunds (when applicable) are processed within 14 business days back to the original payment method.
5. Tutor-Coach Sessions & Scheduling
Rescheduling: Sessions must be canceled or rescheduled at least 24 hours in advance. Otherwise, the session counts as used.
Expiry: Sessions included in subscriptions expire at the end of the billing month. Prepaid sessions are not offered.
No-Shows: If you miss a session without notice, it is forfeited.
6. Tutor-Coaches
Tutor-coaches are independent professionals partnered with Define Dutch.
Define Dutch sets quality standards but is not liable for tutor-coaches’ personal actions outside of agreed services.
Respectful communication is expected both ways.
7. User Conduct
Respect your tutor-coach and other learners. Any harassment, offensive behavior, or disruptive actions may lead to suspension or termination.
8. Content Ownership
All materials, branding, and platform content belong to Define Dutch or our partners. You may use them only for personal learning. Reuse, redistribution, or publication without permission is prohibited.
9. Privacy & Data
We comply with GDPR. See our Privacy Policy for details on data use, storage, and your rights.
10. Disclaimers
Define Dutch is provided “as-is.” While we guarantee structured learning and support, we cannot promise fluency or exam results. Progress depends on your own effort.
Temporary interruptions (maintenance, internet outages) may occur.
11. Limitation of Liability
To the maximum extent permitted by law, Define Dutch is not liable for indirect, incidental, or consequential damages (including lost time, lost profits, or emotional distress caused by Dutch grammar).
12. Force Majeure
We are not responsible for delays or service failures caused by events beyond our control (natural disasters, strikes, pandemics, internet issues, etc.).
13. Changes to Terms
We may update these Terms occasionally. If significant changes are made, we’ll notify you by email or via the website. Continued use of our services means you accept the new Terms.
14. Governing Law
These Terms are governed by Dutch law. Disputes will be resolved in Dutch courts.
